This is an important, and I feel under appreciated problem that we as a community are going to have to deal with as we grow.  Open source doesn't mean free, but it also doesn't mean free to make your own.  I have always thought (like GNU I believe) that should you take and extend an open source application, then you should make that new application available to the creator of the original, and if possible the community.  Now I am not saying that you shouldn't be able to change something and sell it, but you should have to make it available to at least the creator of the original application.

I have never heard the term Borking before, rather funny really.  Lee has done exactly what I mentioned before in every case that I can think of where he has made improvements to a tool or application.  Note, I would say that Lee has done some incredible things for the tools he decides to extend.  I mean the new wireframes is great, and the devnotes he has out is incredible.  As far as core files, well I have refused to dive into that whole thing just yet, I will be a pure 'spec' guy (once we get around to releasing it :))

I know there was some concern not long ago about license issues for the core files.  Let me assure you that legal ramifications, and status are a topic of discussion, and something is being done to address it.  As far as the names dev notes, wireframes, or fuseminder, well if you don't have the tm or copyright to it, well I mean they aren't breaking the law.  I mean look how many different versions of these tools are available, and from any different authors.  My thoughts go like this, if you plan on attempting to make a profit on something, and your branding is important to you, well you need to take the legal steps to protect it.
