Just to clarify,

if you have cf comments only:
<!--- cf comment, 3 dashes --->

you get the empty file error.

if you use a normal html comment, even an empty one, you're ok, you 
don't get the error.

<!-- html comment, 2 dashes -->

just one of those quirky things that you get used to after while. 
sometimes while developing i cf-comment out the cfapplication file 
contents and always have to put something else in there.
