New Rule Exempts Some Small Sources


<x-tad-smaller>Under a new final rule issued by EPA, small businesses in five industries are permanently exempt from the requirements to obtain federal operating permits-Title V permits. The facilities that would be exempted are known as "area sources" of toxic air pollution.

A Title V permit requires a facility to make regular reports on how it is tracking and controlling emissions and to certify each year whether it has met its requirements. The Clean Air Act states that a small business may be exempted from permits if it is "impracticable, infeasible, or unnecessarily burdensome" for the small facility to meet permit requirements.

The new rule exempts the following area sources from the need to obtain permits: dry cleaners, halogenated solvent degreasers, chromium electroplaters, ethylene oxide sterilizers, and secondary aluminum smelters.

This action does not change any requirements governing the control of toxic air pollutants that apply to your facility-you are still required to limit your emissions of air toxics.

EPA Revokes Burdensome Federal Gas Formula Mandate


<x-tad-smaller>In a move to provide greater flexibility in producing clean-burning gasoline to protect and improve air quality, EPA is revoking the 2 percent oxygen content requirement for reformulated gasoline (RFG) nationwide.

The Energy Policy Act authorized the action, which reduces production burdens while continuing to protect the environment with clean fuel blends as the use of ethanol increases. Currently, about 30 percent of gasoline is RFG. The revocation takes effect nationwide on May 6, and in California, 60 days after the regulation's publication in the </x-tad-smaller><x-tad-smaller>Federal Register</x-tad-smaller><x-tad-smaller>.
