You are right, that behaviour is not correct.  However, it has
nothing to do with EWMHBaseStruts.  The manual page says that
TitleWarp works only if the pointer is over the newly mapped menu.
Actually that is not the case, given that the relief around the
menu does not count as part of the menu.

Anyway, TitleWarp should do nothing for root menus.
I'll fix that.
