I think I saw a thread on this problem on the MacNN PowerBooks forum recently and included the fix which involved a little physical manipulation of the latch somewhere. I do not have such a computer so I did not retain the reference but you could find it by searching the forum.

I just spoke with Apple and they have issued a return RMA. My latch does
not stay closed at all and will open in the carrying bag. FedEx will pick it
