There is another way.....
Open the terminal and type:
cd ~
sudo rm -rf .Trash
It will prompt you for your password, then delete everything that is in 
your trash.  After that, you will have to select "Empty Trash' to 
change the icon back in the Dock.
The terminal is your friend.
