According to Apple the System must be in the first 8Gb (on those machines where it applies). To force this the installer will only install if the partition in question is wholly within the first 8Gb. As you've seen you can get around this. Most likely because the System is still within the first 8Gb. Since on most disks with an OS on them the OS is installed first so it will be located at the beginning of the disk. If enough information gets stored on the disk so that an OS update would, in part, get stored after the first 8Gb you could have a problem (depending on what part of the update gets stored there.)
