No, it isn't spyware, there is none for the Mac.
There are applications that let you tweak your TCP/IP settings to better work with cable services, but more than likely the bottleneck is either a crapped out cable modem, or a crowded cable service.
People using cable modems share an available pool of bandwidth among some group, how large depends on the cable company and the local installation.
If you're seeing slowness between, say, 6 PM and 10 PM, and thee are lots of people in your neighborhood with cable service this could be the problem.
Do the obvious: trash TCP/IP prefs, reset your cable modem (the procedure varied depending on the modem), rebuild your desktop, run Disk First Aid.
BTW, OS X works just fine with OS 9.1. Upgrading to 9.2 is not a necessary step.
