Actually, it was Apple's lawyers which got sloppy.

Plaintiffs and Defendants always include a "... and Does 1 through  
100 and Roes 1 through 100, with the actual names of Does and Roes to  
be determined at a later time, once their true names become  
known ..." clause in their documents.
