Well firstly he would have needed a wand to perform the spell. Secondly he didn't even know the spell at the time, even if he could borrow a wand, wich wouldn't work as well as his own did for him. Winkie picked up the wand but didn't cause the dark mark. Winkie was in trouble for picking up the wand. Sheesh this puzzles me. Its as easy as achio and harry would have get his wand back, now poor winkie is in trouble.
