I don't believe so. The objective behind the NCAA rules is that the athlete can not benefit from his/her standing as an athlete and no entity can profit from a knowing athletes activities.
So, if the attorney Huntley Johnson, who is as fine and upstanding a citizen as there ever was, provides a fee system based on ANY defendants ability to pay, then it is kosher. It is expressly forbidden in NCAA bylaws for athletes to accept pro-bono work from any professional (tatto parlors, R&R Truck accessories, etc.). I posed the question as it seems odd to me that over a period of 15-20 years, with multiple coaching staffs, that all players would continue to go to one attorney. I would think that some players would have connections to other able legal counsel with similar fee structures. No malice intended to the finest legal practitioner in the state.
