Could be another layer issue. I just made a change back in January that should make board loading independent from the existing board. Prior to that (and in case there are more bugs I haven't found) the board being loaded was considered at least partially in the context of the properties (such as layer count) of the loaded board. Loading from the cmdline vs menu may be due to the 'new' blank PCB that's sitting there when you load from the menu providing some property during board load.
