Yup. Interesting point! I see the difference being that the public has input and ultimately control over the intellectual property in question; i.e. source code. In other words, the public "owns" the intellectual property, as opposed to a minority of executives at M$ "owning" the property. The restrictions of the GPL could just as easily be argued to be a "necessary evil" to insure that GPL licensed code remains free. If someone doesn't like the GPL, don't use GPL code. Tres simple.
