Not really - basically the patent defines an ICQ entity (which is what M$ has emulated in messenger) - while many computer systems offered some parts of the functionality of ICQ, nobody put the whole thing together in the way that the ICQ team did ... and it's the entity that has been patented - I bet someone at M$ is kicking themselves now for not buying ICQ when they had the chance. Anyone remember what the ICQ purchase price was?
