Very good point and entirely correct. However, this is how the big IT companies play the game. I like to think of the SCO lawsuit as the Linux community's "rite of passage". Kinda like a hazing incident that got a little rough. ;)
It is ultimately proof that Linux is hitting the big time. Is the SCO lawsuit any more ridiculous than Jim Allchin (M$ VP) accusing Linux of being "un-American" (http://www.linuxjournal.com/article.php?sid=5015) or Ballmer's statement that "Linux is Communist" (http://www.theregister.co.uk/content/1/12266.html)? The big difference is that the media covering the IT industry are stupid when it comes to issues of kernel source code, free software licenses, and the convulted UNIX lineage; admittedly an obscure subject. But, because the source code is free, anyone can find out the truth for themselves. The SCO lawsuit will set us back; how long, I don't know. But we will emerge from this little skirmish much stronger and ready for the larger battle to come: the desktop. I personally think that X11 desktop themes form the basis for business plans for small independent software and graphic design shops. And the prospect of other windowing systems for Linux desktops is even more exciting.
