Can't and shouldn't are not the same thing. It may be
against the law to use an open wifi network that you
do not have authorization to use, but that does not
mean it is not possible. Even MAC addresses can be
spoofed or modified, so that is no help.

And as others have pointed out, some wifi networks are
intentionally left open for the public to use. Other
than naming it something obvious, as someone else
pointed out, how can you tell which are open for the
public and which are open because of stupidity? The
simple and only answer is you cannot, unless the
protocols are changed.
