Perhaps I haven't understood your problem. If you want to search in documents 
for the hexadecimal character A9, then you could do something like:

cts:search(doc(), "&#xA9")

(oversimplified example, but it should work)

In your example you used the following string: "&c", but that is not valid. If 
that is meant to be a string of two characters, the first an ampersand, and the 
second the character c, then use: "&c". But I could imagine that you 
actually meant something like: "©", where the copy entity refers to the 
HTML entities, which I though to be known in MarkLogic Server more or less by 
default.
