Sounds related to the output option ‘*output include default attributes*’, but I can’t seem to reproduce it on my Windows ML 6.0-1.1 installation, regardless of that setting. Or perhaps that is because I am running this in QConsole.. Have you tried different versions? Did you test this in QConsole or some other way? Specific HTTP app or XQuery output options?
