Any respectable email service provider would never allow someone to
check the availability of a certain account, if they do then they
should stick a big fat title on the their forehead, you figure the
text!

please tell me which service provider is doing this because I need to
tell all the people I know not to use that provider because they
certainly have no idea what they are doing!

what advantage would you gain from pinging the whois server?
what advantage would you gain from pinging the server that represents
the MX record?
what do you want to ping exactly?
If you use ping to verify that a domain exists then you will fail to
recognize 70% of the domains because they drop icmp traffic.
just check if the domain has an MX record, thats all.
