This is intentionally so. The idea is that you can select a block of lines, then add and remove NB.s from them, where add/remove just toggles the state.
NB.s that are indented are not removed - there is no way to restore them afterwards, moreover it is most likely that you want to preserve any such even after commenting out, and then uncommenting a block of code.
