bootsplash works up to (and including) 2.6.8.1. The earliest patches in the fbsplash archive are against 2.6.8.1. So, we would be dropping support for those earlier kernels, but we don't really support kernels of such age anyway. It's also worth mentioning that fbsplash is included in gentoo-sources.
