well, the ebuild says: "Driver for the bcm4400 gigabit card (in the form of
kernel modules)." so do you have a gigabit ethernet card or just a 10/100?
I have a 10/100 bcm4400 and it works with the in-kernel driver (did not even
know there was an ebuild...) that one works for both 2.4.x and 2.6.x kernels.

my suggestion is: unmerge the bcm4400 packages and try the in-kernel bcm4400
driver.
