Nope, cannot be that one since the GeoServer version is 2.0.2.
That error is normally thrown when Oracle does not have a spatial index for
that geometry column,
except is normally "without a spatial index", not "with"... is it a
transcription error?
A Google search turns out nothing for the error message using "with" instead
of "without"
