This issue might not be relevant any more, but anyway...

I have fixed an issue in OpenLayers sounding like it is this one. The code
might otherwise not be 100% stable because it was not completely tested.
However, the OpenLayers part that requested black tiles from the WMS if it
is outside the extent that you give OpenLayers is fixed in this version. You
can find my fork on Github @ https://github.com/geekdenz/openlayers .
