That's odd, we have code to reproject the filter from the declared SRS down to native before execution: https://github.com/geoserver/geoserver/blob/9406f0e93d8bef0da25df322ef9a7054d6d74ef0/src/main/src/main/java/org/vfny/geoserver/global/GeoServerFeatureSource.java#L441 In your case I assume you have the "reproject to native" SRS handling since the two SRSs are pretty darn different right?
