David, Yeah, that's a great question. I'm not totally sure either, but for now there's *NO* use of the opengis FilterCapabilities.
At some point in the future I'm imagining that we'll bring geotools FilterCapabilities into line with the opengis FilterCapabilities interface, but this might involve revising the opengis FilterCapabilities, as it's currently implementation-free and possibly buggy/incomplete.
