You are indeed right. I've opened a jira issue to fix this one too:
http://jira.codehaus.org/browse/GEOS-1235

(when I come back from vacation, and only on 1.6.x, a little bit
of estimates show that the work to backport this to 1.5.x is simply
too big for us to undertake for free).
