Note that GeoServer has done a lot of work on KML output. We never put it in to GeoTools since no one ever asked about it, and a lot of it's ended up using GeoServer specific stuff. But in general we're happy to have things migrate from GeoServer to GeoTools and can redo the license to be lgpl. So if you're interested in taking the code and making it more generic for GeoTools let us know.
