At the same time I have this nagging feeling that it's not case insensitive because various used asked for it that way, but I can't find the relevant discussion. What worries me the most is that if we flip the behavior we might break someone application irreparably. People using GeoTools can use FilterFactory2 and exert control over the case sensitivity flag, but in CQL and OGC Filter 1.1 there is no way to state a case sensivity flag...
