This is due to two issues:
- npe on geotools (http://jira.codehaus.org/browse/GEOT-3372)
- ogr2ogr is not able to handle an empty gml feature collection
For the latter the solution is to use an empty shapefile instead, resurrecting
the shapefile writing code for the case of empty collections
