bbox filter returns wrong result under special circumstances

BBOX Filter encoding in ArcSDE datastore is not OGC conform and does return
wrong results in some special cases like:
When a complete outer geometry has an envelope that interacts with bounding
box,
it's included in the result. (please see the attached image for a more clear
description.)
OGC says BBOX is equal to 'Not Disjoint' expression.
But ArcSDE datastore uses geometry envelope comparison on bounding box.
Is this an optimization for better performance?
