Euff... this might be more a matter of politics than a tecnical one... or
not, I never looked into it that much.
The thing is, there are schemas out there that are important and meant to
be GML based, that fail this rule.
Right now we cannot encode them... but this is not really helping us, yes,
we can sit on our high horse and state that we are right,
but in the meantime people are going to use other tools to solve their
practical needs.
If it was me, I would look and see if it's possible to relax the encoders
so that they can also encode these (wrong but not
uncommon) structures
