Hmm... I don't have time to re-read the spec again. Anyways,
Geotools does not handle polygon validity by itself, JTS does it.
You'll have to discuss this on the JTS mailing list and see what Martin 
Davis thinks of it. Even if your interpretation of the spec was correct,
we would be unable to provide a fix, JTS developers have to do that.
