Interestingly enough I filed a GeoServer jira today on the same issue
(GEOS-937) that should link to this issue in GeoTools. The filter spec
does give the impression you can specify other units for the distance
than the one your data is stored in.

Maybe when I get some time I'll look into it, that is after I finish
my course on open web mapping which is going to get released as CC
share alike open course ware when its finished so should get us some
new users (Well mostly GeoServer, uDig and MapBuilder)
