In case anyone cares, I've just created a JIRA ticket for 12-RC1... it
fails filtering a NZGD2000 SimpleFeatureCollection which was read from a
Shapefile. This works fine in v11.2,

CQL.toFilter("DWITHIN(the_geom, " + rwyGeom.toString() +
