The APIs are for use free of charge although, like every other API, even those 
that have been identified as open source, the use of which are subject to 
certain terms and conditions.  In this case you identified that  the 
'distribution' of our API is subject to additional terms and conditions.  

So my statement was accurate but for the purposes of clarity I will rephrase it:

You may,  subject to the terms and conditions stated on our website regarding 
its commercial use and distribution, use the APIs at no charge.

Thanks for helping clarify my statement.

according to 2.c. of the terms
(http://developer.skyhookwireless.com/terms/) i have to contact you
before launching any service/application:
  "Skyhook shall, in its sole discrection, approve Licensee's request based on 
the execution of
   a mutually acceptable distribution license."

i'm sorry, but i fail to see that i can "use the APIs at no charge" as long as 
the 'real' terms are hidden. i hope i'm misunderstanding
something. if not, you seem to.
