Scarey stuff. Do see to reporting this to your ISP and theirsif you know
it. I dont recognize things like signitures because Im on so many many
lists and have a bad memory for people's names, so seeing "tj" didnt alert
me to anythign, sorry. I appreciate your recent post setting things
straight, no hard feelings.

It wasnt specifically the post that "claimed to be from you" that upset me,
its just the idea of postal shipping mammals in general. This topic comes
up on many many lists (for rats, mie, hamsters etc.). I just can't
comprehend how peopel can get so hostile with soemone for stating the fact
of the law. Yes, ultimatly it IS their choice if they want to break the law
or not and take the risks of that- just liek it is people's choice to use
drugs or not, or to drink and smoke underage (which it is in my city)- but
just at with drugs and alcohol and smoking- you may get away with it- or you
may not, and you shoudl know hat COULD happen if you are caught. I feel its
important to get the info out about it, so at least people KNOW the risks,
and if just one person stops conciderign postal shipping, it was well worth
it!

I just want to clarify one thing:

>they
>said that gerbils were not listed as being unmailable, so they didn't
>see a problem with it. BUT, that is here and it may be different<

The rule book as its written states mammals as nonmailable, then provides
8examples* of nonmailable mammals. gerbils are not listed yes but other
rodents (rats, mice ) ARE listed, and the rules do state those are examples
only.

This exact idea was used as a defense in a court case a few years
backinvolving the shipping of birds by a hobby bird breeder. They tried
getting out of the conviction by showing the species of birds they were
shipping wasnt listed specifically as nonmailable. The court upheld the
wording that the listed bird species were examples only and nonmailable
species werenot limitted to that list. The person was still convicted.

The same thing happened with spiders a while back also (the kind peopel keep
for pets, tarantulas etc.) and eventually because someone kept insisting
spiders were mailable insects (they arent insects they are archnids, closer
related to say lobsters and crabs then say a beetle or ant), that they had
to actually write in spiders specifically.

Im not aware of any court cases of soemone doing this with gerbils, but it
stands to reason if the species list question was brought up and struct down
for a bird breeder, it would for a rodent breeder also.
