No, and this is really important.

The Elba code is JBoss code, and thus will NOT enter the Apache CVS, nor can it be licensed with the Apaache License. The ASF will *not* let another entity's license be violated.

Any code that comes to the ASF will be either new code, or code that is clearly free of any encumbrance by any other author or organization. The point of the incubation process is to ensure that this rule is followed both to the letter and the spirit.
