Indeed, this is the only reason why creating a JavaMail API is necessary. At least this way, we have permission to use it; however, that's not to say that we can't use the JavaMail (mailapi.jar) binary for redistribution purposes.
Unofficially, you can distribute Sun BCL libraries (javamail.jar and activation.jar) as part of a distribution, but it cannot be downloaded independently from Apache.
