I am not sure if I got what you have described below entirely.
A brick can be part of only one volume. So two volumes with a brick in common between them is not allowed.

Check if the problem you are facing is similar to that explained in https://bugzilla.redhat.com/show_bug.cgi?id=GLUSTER-3320

What is the version of gluster are you using?
