Open JDK is Sun's but it isn't the same as their proprietary Java. What
most people probably think of as the "official" java implementation, is
still non-free and can't be entirely GPL'ed by Sun, because a third
party holds the copyrights on some bits. 

Sun has GPL'ed what they can and the Open JDK folks are in the process
of developing replacements for those parts that weren't GPL'ed. In the
meantime, software that depends on the proprietary Java is still
considered non-free.
