Technically I believe this to be true, unless release of said sw poses a
"National Security Risk" which is what I understand the FBI tried to hide 
behind with Carnivore.

Call the FPLC and ask whoever answers who you would ask such a question to.
Or, take a ride over, and wander around asking questions.

You might also consider e-mailing rms about this, he's pretty up to speed on 
this type of thing, so he'd at least know who to ask.
