The TOC (Table Of Contents) for a CD contains track numbers and lengths, and other low-level information about the CD. If you have a readable CD, it has a TOC. While certain applications might defer writing the TOC, you will always have one on a "normal" CD. > Which works great. AFAIK, the song list that appears in many CD player programs is not read from the CD. Using information such as number of tracks and the length of each track, such programs generate a unique "signature" for a disc, and then look it up in an online database.
