Full stop. 

Party B does NOT "copy and distribute". 

Party B is doing nothing that would constitute assent to the GPL. 

Party B distributes under *statutory* right codified in 17 USC 109. 

Party B is not bound by the GPL because there was no assent to its 
terms.
