[RedHat and Novell refer to the FSF Action, IBM adopts by reference] So it appears that Wallace managed to lure defendants to refer themselves and the Circuit Court to parallel action in which a federal judge held that his complaint "states a claim upon which relief can be granted", that his "allegations sufficiently set forth a violation of the rule of reason", and in which a federal judge even managed to infer an anticompetitive effect (reduction in output) under rule of reason, apart from per se treatment of predatory pricing. Kudos to Wallace.
