Unpredictability is what you get when a jury decides your fate. Maybe a judge too. If you can control the outcome yourself by settling and getting a reasonable deal, then that's what you do.

The SFLC and FSF's continuing voluntary dismissal strategy is simply an abuse of the legal system in an attempt to intimidate folks.
On each occasion where the cases were dismissed, the defendants (or their proxies, in the case of Verizon/Actiontec) made the source code available as required by the GPL. Therefore there was no reason or possibility for the cases to continue.
