The above ruling is was about a court dismissing a case upon the merits, not a voluntary dismissal by the plaintiffs. Not only that, the Supreme Court concluded "...the Maryland Court of Special Appeals erred in holding that the dismissal necessarily precluded the bringing of this action in the Maryland courts."
