MySQL's case/claim *regarding the GPL* was a contract case, NOT COPYRIGHT INFRINGEMENT. MySQL complained about other non-contract (tort) matters as well in addition to the GPL contract claim. Judge Saris was not supposed/allowed to rule sua sponte that certain provisions of the GPL are unenforceable and she simply denied the plea for injunction regarding alleged breach of the GPL on other grounds. regards, alexander.
