The arrest was a consequence to a raid conducted by officials of the Food and Drugs Department at Dr Birader's clinic on March 20, where they found him illegally stocking allopatic drugs. The officials seized all the allopatic drugs and subsequently the filed a complaint against the doctor at the Mapusa police station. Stocking drugs without a licence is an offence under the Drugs and Cosmetics Act, an official in Food and Drugs department said.
The same official said that the doctor did not have a MBBS degree from any of the medical colleges in the country. Further any doctor who wishes to practice medicine has to first get registered with the State Medical Board, which he has not.
According to the Food and Drugs Administration Director Mr S N Tripathi the concerned doctor is not a registered medical practitioner under Rule 2 (ee) of the Drugs and Cosmetics Rule 1945. Acting on the complaint filed by food and drugs inspector Ms Jyoti Dessai, police raided Dr Birader's clinic at Angod, Mapusa on Tuesday evening and arrested him.
Soon after, Dr Birader complained of chest pain and was admitted at Asilo's from where he was referred to Goa Medical College, Bambolim, and then back to Asilos PI Sammy Tavares informed. He was released on bail by JMFC, Mapusa on Wednesday on condition that he should report to the police station for eight days and that he should not leave the State without prior permission of the court.
The doctor was arrested under section 2, 18c and 27 of the Drug and Cosmetics Act (storing, distributing and selling drugs without licence) and section 420 IPC (cheating), the police said. -------------------------------- HERALD 28/3/03 page 3 --------------------------------
