Most of the Public Notices issued by theMunicipalities in Goa are merely issued as abundant caution. The Municipal Administration can faithfully implement these notices only if the Councillors and the Minister of Urban Development show political will.
Take the latest notice issued on the 9th instance on the local dailies. It warns the Public that occupying 'buildings' without the OCCUPANCY CERTIFICATE viz a certificate certifying the fitness of the premises for occupation; is violative of para No:13,of the Building byelaws and can be sealed under para 184 A of the Municipalities Act 1968, and rules thereof; This to my mind is nothing but a mockery. If the Municpal authorities so desires to take action; they can alongwith the respective Ward Councillors visit a few of the Buildings in the Municipal area for which it has issued Building Construction licences (ordinarily valid for one year and renewable upto three years) and have yet not been issued the Occupancy Certificates as per their records. If they are found to be occupied by the "occupiers" they can easily seal the premises. But most Indian laws do not believe in "suo moto" action. One need to act i.e complain then, authorities will try to ascertain whether it is their jurisdiction and then may react depending on the will of their political patrons. But then what happens when the Municpal authorities themselves have issued Occupancy Certificates, provided NOC for power & water supply and also assessed one of two such buildings to House Tax which were constructed WITHOUT a Building Construction Licence and are now occupied, for nearly a decade. Will the Chief Minister of Goa kindly direct his cabinet colleague the No:2 and Minister for Urban Development, the Chief Officer, Municipal Engineer of Margao Muncipal Council all belonging to the ruling pary to examine an interesting file pertaining to two such buildings constructed on property surveyed under PTS 152 Chalta Nos 62 & 72 of City Survey Margao belonging to a resident Indian and two foreign nationals of Indian origin vide: Building Construction Licence A/172/87 dated 27/11/1987 Occupancy Certificates No:3(OC)/1/91-TECH/135 dt 7.11.1991 No: 3(OC)1/93-94/TECH-133 dt 26.11.1993 at Borda Ward No:12 Margao by a builder a relative of an ex Chief Minister of Goa, hailing from South Goa Parliamentary Constituency? If the contention as alleged by this writer is found correct will the authorities CANCEL such Occupancy Certificates or DEMOLISH such structures or REGULARISE these illegal buildings on payment of "some consideration" ? If none of these then why waste public funds in such Public Notices? GODFREY J. I. GONSALVES Borda Margao Goa. ________________________________________________________________________ Yahoo!
